What the governing framework requires

An L-1B specialized knowledge employee may qualify to open or work in a new U.S. office through an individual petition. The petitioner must establish specialized knowledge, sufficient physical premises, a qualifying organization, and financial ability to remunerate the beneficiary and commence doing business. Unlike L-1A new office cases, the L-1B regulation does not require proof that the office will support a managerial or executive position within one year.

The beneficiary must satisfy the ordinary L-1B knowledge standard

New office status does not lower the specialized knowledge requirement.

The petition should establish the beneficiary's knowledge and why the startup operation requires it.

Sufficient premises must be secured

8 C.F.R. §214.2(l)(3)(vi) expressly requires sufficient physical premises to house the new office.

Sufficiency depends on the intended business operation.

The U.S. business must be or become part of the qualifying organization

The ownership and control relationship between the foreign employer and U.S. organization should be documented completely.

The petitioner must be able to pay the beneficiary and start the business

The regulation expressly requires financial ability to remunerate the beneficiary and commence doing business in the United States.

The L-1B new office standard is not the L-1A one year managerial test

L-1A new office petitions must show that the U.S. operation will support a qualifying managerial or executive role within one year.

The L-1B regulation instead focuses on premises, qualifying organization, financial ability, and specialized knowledge.

Build both the new office and specialized knowledge record

  • Lease or premises evidence
  • Corporate relationship records
  • Foreign company operations
  • Financial statements
  • U.S. capitalization
  • Beneficiary training and experience
  • U.S. job duties
  • Business plan
