What the governing framework requires

An L-1B extension should establish that the qualifying corporate relationship continues, the organization remains doing business, the beneficiary continues to work in a specialized knowledge capacity, and the requested period does not exceed the applicable maximum stay. Extensions may generally be granted in increments of up to two years.

The actual U.S. duties should continue to involve specialized knowledge

The petition should update the beneficiary's responsibilities rather than rely entirely on the initial duty description.

The filing should explain how the specialized knowledge is being used in the current organization.

The specialized knowledge theory should remain credible

Changes in the beneficiary's responsibilities, team, products, systems, or projects can alter the analysis.

Updated evidence can show how the knowledge continues to be special or advanced.

Ownership and doing-business requirements continue

Mergers, acquisitions, restructurings, or foreign company changes should be reviewed before extension.

The first extension after a new office filing uses the new office extension rules

After the initial one year new office period, the petitioner must establish the actual development and financial status required by the regulations.

Later extensions are treated under the ordinary continuing L rules.

Remaining L-1B time should be calculated before filing

The regulation generally limits specialized knowledge L employment to five years, subject to the applicable rules regarding time spent in the United States and qualifying periods abroad.

Update rather than mechanically reuse the initial filing

  • Current job duties
  • Updated specialized knowledge evidence
  • Current organizational chart
  • Corporate relationship records
  • Doing-business evidence
  • Travel and status history
  • Prior approval notices
  • Current project records
