EB-5 Green Card
EB-5 Conditional Permanent Residence
What the two-year conditional Green Card means, when the period starts, travel and employment status, family members, and the later I-829 petition.
Direct answer
What the governing framework requires
EB-5 investors, spouses, and qualifying children obtain permanent resident status on a conditional basis under INA §216A. The conditional period generally lasts two years. The investor has the rights and obligations of a permanent resident but must timely file Form I-829 to remove the investment-based conditions.
01 · Start Date
The two-year period begins when permanent residence is obtained
For an adjustment applicant, the relevant date is the grant of conditional permanent residence.
For a consular applicant, it generally begins upon admission on the immigrant visa.
Conditional permanent residence begins when EB-5 permanent resident status is actually obtained. For an adjustment applicant, that is generally the date USCIS grants adjustment to conditional permanent residence. For a consular applicant, it generally begins upon admission to the United States with the EB-5 immigrant visa. Because derivative family members may enter or adjust on different dates, their conditional periods and card expiration dates may differ from the principal investor's. The family should track each person's start date separately and preserve the approval notice, immigrant visa admission record, and Permanent Resident Card.
02 · Permanent Resident Status
Conditional residents are permanent residents
They may live and work in the United States subject to the same general permanent resident obligations and the special EB-5 condition-removal requirement.
An EB-5 conditional permanent resident is a lawful permanent resident during the conditional period. The person may generally live and work in the United States and is subject to the same ordinary obligations that apply to permanent residents, while also remaining subject to the EB-5 condition-removal requirement. Conditional status should not be confused with temporary nonimmigrant status. The critical difference is that the residence remains subject to termination if the investor does not comply with INA 216A and the Form I-829 process or if USCIS ultimately determines that the statutory conditions were not satisfied.
03 · Derivatives
Spouse and child residence is also conditional
Derivative entry dates can differ from the principal investor's date and should be tracked carefully.
A qualifying spouse and qualifying children can receive derivative conditional permanent residence based on the principal EB-5 investor. Their status is derivative of the EB-5 classification, but each family member has an individual residence record and may have a different admission or adjustment date. That difference matters when tracking card expiration, documentary proof of status, and removal-of-conditions filings. Relationship changes can also affect procedure. Current Form I-829 instructions address spouses, former spouses, children who turn 21 or marry during conditional residence, and survivors, including circumstances in which a derivative may file separately.
04 · Travel
The expired card and I-829 receipt can document continued status after timely filing
USCIS currently issues I-829 receipt notices extending card validity for 48 months beyond the card expiration date.
A conditional permanent resident may travel internationally subject to the ordinary rules governing permanent residents and the need to present valid evidence of status. When a timely Form I-829 is accepted, USCIS extends conditional resident status for the period stated on the receipt notice. USCIS has used receipt notices that extend card validity for 48 months beyond the card expiration date. A traveler may need the expired Permanent Resident Card together with the Form I-829 receipt notice, and additional evidence may be necessary if the documented extension expires while the petition remains pending.
05 · Failure to File
Missing the I-829 requirement can lead to termination of conditional status
Late filing remains possible where USCIS accepts good cause and extenuating circumstances.
Form I-829 generally must be filed during the 90-day period immediately preceding the second anniversary of obtaining conditional permanent resident status. Current USCIS instructions state that failure to file during that period can result in termination of conditional permanent resident status and removability. A late filing may still be accepted if USCIS concludes that the delay was for good cause and due to extenuating circumstances. Because the consequences can be serious, the filing window should be calendared from the actual conditional-residence start date rather than from a project closing, petition approval, or another unrelated milestone.
06 · Planning
Track the I-829 deadline when conditional status begins
- CPR start date
- Green Card expiration
- 90-day filing window
- Project evidence
- Job creation evidence
- Derivative family dates
Removal-of-conditions planning should begin before the statutory filing window. Counsel should confirm the conditional-residence start date, card expiration, project status, investment and sustainment evidence, job-creation evidence, material project changes, and the status of any derivative family members. The Form I-829 record should be organized around the requirements applicable to the investor's filing date and project structure. If the project encountered delays, repayment, redeployment, litigation, or significant business changes, those issues should be identified early so the filing can explain them with documents rather than address them for the first time after a request for evidence.
