Business Immigration Comparison
L-1 Visa vs. EB-5 Green Card
Compare multinational company transfer with permanent residence through investment.
Direct answer
What the governing framework requires
L-1 is a temporary intracompany transfer classification based on a qualifying multinational organization and qualifying foreign employment. EB-5 is an immigrant investment classification based on statutory capital, lawful source, and job creation. L-1 has no statutory investment minimum or 10-job rule; EB-5 does.
01 · Eligibility Basis
The categories are built around different facts
L-1 requires a qualifying organization and employment abroad. EB-5 does not require prior foreign-company employment.
L-1 and EB-5 start from fundamentally different eligibility theories. L-1 is based on a qualifying multinational organization and a beneficiary with qualifying employment abroad who will work for a related US organization in an authorized L-1 capacity. EB-5 is based on a qualifying investment in a new commercial enterprise, lawful capital, and required job creation. A person can therefore be financially able to pursue EB-5 yet have no L-1 basis, or have a strong L-1 case without making an EB-5 investment.
02 · Capital
L-1 has no statutory investment minimum
A new office must nevertheless show sufficient capitalization and financial ability.
There is no statutory minimum investment amount for L-1. Even so, funding can be important, particularly for a new office, because the petitioner must show a credible US operation with the financial ability and business plan to support the proposed role. EB-5 is different: the statute establishes minimum qualifying investment amounts, and the investor must document lawful source and path of the capital. Money spent to launch an L-1 business should not automatically be assumed to satisfy EB-5 investment requirements.
03 · Employees
L-1 staffing is functional rather than numeric
An L-1A case must show that the organization can support managerial or executive duties. EB-5 generally requires 10 qualifying full-time jobs.
L-1 staffing is evaluated in relation to the claimed position and the business. For L-1A, USCIS considers whether the organizational structure and personnel allow the beneficiary to function primarily as a manager or executive; there is no fixed statutory employee count. EB-5 generally requires at least 10 qualifying full time jobs per investor. Regional center investors may count qualifying direct and indirect jobs under the current statutory framework, while direct standalone cases generally rely on qualifying direct employment.
04 · Immigration Status
L-1 is temporary while EB-5 is immigrant
EB-5 leads to conditional permanent residence.
L-1 is a temporary nonimmigrant classification and is granted for limited periods subject to the applicable maximum stay rules. It can coexist with later permanent residence planning, but L-1 approval itself is not a green card. EB-5 is an immigrant classification. Successful immigrant visa processing or adjustment based on EB-5 results in conditional permanent residence, followed later by the removal of conditions process. The categories therefore differ not only in eligibility but also in the immigration status they are designed to produce.
05 · Ownership
L-1 depends on corporate relationship rather than investor nationality
Ownership and control evidence establishes the qualifying organizations.
L-1 ownership evidence is used to establish the qualifying relationship between the foreign and US organizations. The beneficiary does not need to be a treaty national, and personal investment is not the basis of L-1 eligibility. EB-5 does not require the same multinational corporate relationship. Instead, the investor must make the qualifying investment and satisfy the statutory investor requirements. Corporate diagrams, capitalization records, and operating agreements should therefore be evaluated for the legal purpose of the category actually being pursued.
06 · Choice
Existing multinational operations often favor L-1
An entrepreneur without qualifying foreign employment cannot create L-1 eligibility merely by investing money.
Existing multinational operations often make L-1 the more fact-dependent category to test first because the foreign company, qualifying relationship, foreign employment, and proposed US role either exist or they do not. EB-5 may be available without those facts but introduces its own capital, lawful source, job creation, and immigrant process requirements. The comparison should also consider the investor's desired operating role, family objectives, available capital, timing, and whether the business itself can support the evidence required by the selected category.
