Essential Employee Timing
Duration of E-2 Essential Employee Need
Explain not only why an E-2 employee's skills are essential, but how long the enterprise is expected to require them.
Direct answer
What the governing framework requires
An E-2 essential employee must establish both qualifying skills and the length of time those skills will be needed. Some expertise can remain essential on an ongoing basis, such as continuous product development, quality control, or a service otherwise unavailable. Other expertise may be essential only temporarily, including startup or training assignments that may reasonably last one or two years.
01 · Burden
Duration is part of the essentiality analysis
The company and applicant should explain why the expertise is needed now and why the stated period is reasonable.
Duration is an express part of the essentiality inquiry. The current FAM places the burden on the applicant at the initial application and at each later application to establish both the specialized skills and the length of time those skills will be needed. The explanation should connect the requested period to the actual business reason for the assignment rather than simply repeat the maximum period available under E classification. A credible timeline identifies what the employee will accomplish, why the expertise is needed during that period, and what facts would support continuing need later.
02 · Long-Term Need
Some functions can remain essential indefinitely
Current FAM examples include continuous product improvement, quality control, or provision of a service otherwise unavailable.
Some specialized skills may remain essential for as long as the business continues to need them. The current FAM gives examples such as continuous product improvement, quality control, or providing a service otherwise unavailable. A long term theory should explain why the need is recurring rather than merely transitional and why the employee's expertise remains specialized in the context of the enterprise. Ongoing product development cycles, quality systems, proprietary technical functions, continuing client requirements, or other durable operational responsibilities can help show why essentiality is not expected to disappear after initial startup activities.
03 · Short-Term Need
Startup and training can justify a shorter assignment
The FAM notes that one or two years may be appropriate where the employee is needed for startup operations or to train and supervise technical personnel.
Other essential employee assignments are inherently temporary. The FAM identifies a relatively short period, such as one or two years, as potentially reasonable when the employee is needed for startup operations, a new activity, or training and supervision of technicians in manufacturing, maintenance, or repair functions. A short term filing should identify the startup or training objective, the work to be completed, the employees who will receive knowledge or supervision, and the expected milestones. Where the theory depends on temporary enterprise familiarity, the duration should match the period needed to transfer that knowledge.
04 · Changing Conditions
A skill that is essential today may not remain essential later
Local hiring, training, technology transfer, process maturity, or changes in the enterprise can reduce the need over time.
Essentiality can change as the US enterprise develops. Expertise that is highly specialized at the beginning may become less unusual after local employees are trained, processes are documented, technology is transferred, products mature, or the relevant service becomes available through other personnel. The current FAM specifically recognizes that what is specialized and unique today may not remain so in later years. A well supported case should therefore describe the present need accurately and avoid claiming indefinite necessity when the business plan itself anticipates that the function will become locally sustainable.
05 · Renewal
Later applications should reestablish continuing essentiality
The applicant should not assume the original essentiality determination automatically proves the same need years later.
A prior E visa or status approval does not eliminate the need to establish continuing essentiality in a later application. The FAM requires the duration issue to be addressed again at subsequent applications. The updated record should show what has happened since the earlier adjudication, what specialized work remains unfinished or recurring, and why the employee's skills are still needed. If US employees have been trained or the business has materially changed, the filing should address those developments directly rather than relying only on the reasoning and evidence submitted years earlier.
06 · Evidence
Tie duration to an operational timeline
Project schedules, product-development plans, training schedules, expansion milestones, replacement plans, and employer letters can explain the expected duration.
The duration explanation should be supported by operational evidence that fits the assignment. Useful records may include project schedules, implementation plans, product roadmaps, quality control responsibilities, training calendars, staffing plans, hiring timelines, replacement plans, expansion milestones, technical deliverables, and employer letters describing the expected period of need. The evidence should distinguish a continuing specialized function from a finite startup or knowledge transfer project. Dates should also be internally consistent across the business plan, organizational materials, employment letter, DS-156-E, and any prior E filings so the requested duration has a clear factual basis.
