E-2 Nonimmigrant Intent
E-2 Intent to Depart the United States
The E-2 departure requirement, why an applicant does not need to maintain a foreign residence, and how immigrant petitions or long term permanent residence plans affect the analysis.
Direct answer
What the governing framework requires
An E-2 applicant must intend to depart the United States when E status terminates, but the applicant does not have to maintain a foreign residence that cannot be abandoned or intend to remain only for one short fixed period. The current FAM states that an unequivocal expression of intent to depart when E status ends is normally sufficient, although an immigrant petition can require closer examination.
01 · Legal Standard
E-2 requires intent to depart when E status ends
9 FAM 402.9-4(C) governs intent to depart for both E-1 and E-2 applicants.
The applicant does not need to prove an intent to remain in the United States for only one specific short period.
The applicant instead must establish an intention to depart when E status terminates.
02 · Residence Abroad
An E-2 applicant does not need an unabandoned foreign residence
The current FAM expressly states that an E applicant does not need a residence in a foreign country that the applicant has no intention of abandoning.
The FAM even recognizes that an applicant may sell a foreign residence and move household effects to the United States.
This makes E-2 intent different from classifications in which maintenance of a residence abroad plays a more direct role.
03 · Long Term Status
Repeated E-2 renewals do not automatically contradict temporary intent
E classification can often be renewed when the enterprise and applicant continue to qualify.
An applicant can therefore intend to operate the business for many years while still maintaining the required intent to leave when E status ultimately terminates.
The distinction is between intending to remain while lawfully maintaining E status and intending to remain permanently without another lawful basis.
04 · Permanent Residence Planning
An immigrant petition can require closer scrutiny
The FAM specifically addresses applicants who are beneficiaries of immigrant visa petitions.
Such an applicant must still satisfy the consular officer that the present intent is to depart at the end of authorized E stay rather than remain to adjust status or otherwise remain in the United States in violation of the E classification.
Long term planning should therefore be handled carefully when an E-2 investor is also pursuing a separate immigrant strategy.
05 · Application Record
Intent should be consistent across forms, interview answers, and immigration history
Intent is evaluated from the complete record rather than from one sentence in a legal brief.
The DS-160, prior visa applications, immigrant petitions, adjustment filings, travel history, statements during the interview, and other immigration records can all matter.
An applicant should answer questions truthfully and consistently rather than attempting to manufacture artificial foreign ties that are not legally required.
06 · Planning
E-2 and permanent residence can coexist only when each classification is independently satisfied
E-2 does not itself provide permanent residence.
An E-2 investor may later qualify for EB-5, EB-1C, family based immigration, or another immigrant category, but that later strategy must satisfy its own legal requirements.
The existence of a future immigration objective should not be confused with present eligibility for E-2 nonimmigrant classification.
Questions and answers
Frequently asked questions
Do I need to keep a home outside the United States for E-2?
No. The current FAM states that an E applicant does not need to maintain a foreign residence that the applicant does not intend to abandon.
Can I sell my home abroad and still apply for E-2?
Potentially. The FAM expressly recognizes that an E applicant may sell a foreign residence and move household effects to the United States.
Can I renew E-2 for many years?
Potentially, as long as eligibility continues. Long term lawful E status is not the same as an intention to remain permanently after E status ends.
Can I have an immigrant petition and still receive E-2?
Potentially, but the FAM states that the applicant must satisfy the officer of the intent to depart at the end of authorized E stay rather than remain to adjust or otherwise stay.
Is E-2 a dual intent visa?
E-2 is not generally described as a statutory dual intent classification. The applicant must establish the required intent to depart when E status terminates.
Does E-2 automatically lead to a Green Card?
No. Permanent residence requires a separate immigrant basis.
