What the governing framework requires

An EB-5 investor processing abroad generally moves to Department of State immigrant visa processing after USCIS approves Form I-526 or I-526E and a visa can be allocated. The principal investor and qualifying derivatives complete immigrant visa processing and, after admission to the United States, obtain conditional permanent resident status under INA §216A.

USCIS approval establishes the EB-5 immigrant classification

Approval alone does not issue an immigrant visa.

USCIS approval of Form I-526 or Form I-526E establishes the approved immigrant petition but does not itself issue an immigrant visa or confer permanent resident status. For an investor processing abroad, the approved petition generally proceeds to Department of State immigrant visa processing when the case is eligible to move forward. The investor should retain the USCIS approval notice and continue monitoring visa availability because an approved petition can remain subject to numerical limits. Project or investor developments arising after approval should also be reviewed before the visa interview when they could affect continuing eligibility or the consistency of the immigration record.

The National Visa Center coordinates document processing when appropriate

The investor should respond accurately to civil-document, fee, and immigrant visa application requirements.

After USCIS sends an approved employment preference petition to the National Visa Center, NVC creates the immigrant visa case and provides instructions for further processing. Applicants use the Consular Electronic Application Center for the applicable fees, Form DS-260, civil documents, and other case requirements. NVC reviews the submitted materials before an interview can be scheduled. Current Department of State guidance generally schedules immigrant visa applicants in their country of residence or, if requested, country of nationality, subject to limited exceptions. Applicants should therefore keep their residence information current and follow the instructions for the post assigned to the case.

A visa number must be available for issuance

Priority date and reserved or unreserved classification should be monitored through the Visa Bulletin.

An immigrant visa number must be available before an employment preference immigrant visa can be issued. EB-5 investors should therefore track the priority date, country of chargeability, and reserved or unreserved category through the monthly Visa Bulletin. Petition approval and document completion at NVC do not override numerical limits. A case may be documentarily complete but remain at NVC until an interview can be scheduled with a visa available. Because reserved and unreserved EB-5 categories can move differently, the visa analysis should use the investor's actual project classification rather than assuming all EB-5 cases share the same cutoff date.

The consular officer evaluates immigrant visa eligibility

Inadmissibility, identity, civil records, security screening, and consistency with the approved EB-5 petition can be reviewed.

At the immigrant visa interview, the consular officer determines whether the applicant is eligible to receive the visa. The review can include identity, civil records, security screening, medical documentation, admissibility, and consistency with the approved EB-5 petition. The investor should understand the source and path of funds, project structure, investment, and material facts disclosed to USCIS, even though the petition has already been approved. Material changes or discrepancies should be addressed accurately. Derivative family members must also establish their own qualifying relationship and admissibility, and the consular post may request additional records before completing adjudication.

Conditional residence begins through admission on the immigrant visa

The two-year conditional residence period is tied to the date permanent resident status is obtained.

Visa issuance is not the final step in obtaining conditional permanent residence. The EB-5 immigrant visa permits travel to a US port of entry to seek admission as a permanent resident. In a consular case, conditional permanent resident status generally begins when the investor is admitted to the United States in the EB-5 immigrant classification. That admission date is important because it starts the two-year conditional residence period and later determines the Form I-829 filing window. The investor should preserve the immigrant visa, admission record, and Permanent Resident Card and verify that the biographic and classification information is accurate.

Derivative processing should be coordinated carefully

  • Spouse eligibility
  • Child age and CSPA
  • Civil documents
  • Visa availability
  • Accompanying or following to join
  • I-829 planning

A qualifying spouse and child can generally immigrate as derivatives of the principal EB-5 investor, subject to visa availability, relationship requirements, and individual admissibility. Family members may accompany the principal or, when permitted, follow later, so their immigrant visa and conditional-residence dates may differ from the investor's. Child age should be monitored under the Child Status Protection Act because timing and sought-to-acquire requirements can matter. The family should maintain marriage and birth records, prior-marriage termination documents where applicable, passports, and immigration notices so the derivative relationship remains readily documented through visa processing and the later Form I-829 stage.
