What the governing framework requires

USCIS places its current consolidated L-1 guidance in Volume 2, Part L of the USCIS Policy Manual. USCIS describes this guidance as controlling agency policy that superseded related prior L guidance. It covers intracompany transferees across eligibility, ownership and control, qualifying organizations, beneficiary requirements, documentation, adjudication, blanket petitions, and periods of stay.

The manual consolidates USCIS L-1 guidance

USCIS moved substantial L-1 guidance from older field-manual materials into the Policy Manual. Current adjudication should therefore use the current Part L text.

The manual explains ownership and control

Part L discusses qualifying organizations, branches, subsidiaries, affiliates, joint ventures, sole proprietorships, and other structural questions within the statutory and regulatory framework.

The manual develops foreign-employment and U.S.-position analysis

The guidance addresses the qualifying year abroad and the standards for managerial, executive, and specialized knowledge employment.

Chapter 8 provides detailed documentation guidance

USCIS identifies evidence relevant to doing business, corporate relationships, foreign employment, U.S. positions, new offices, and specialized knowledge.

Part L also addresses L time limits

Extension periods, new-office validity, maximum L-1A and L-1B stay, and related timing questions should be analyzed under the regulation and current policy.

Agency policy remains subordinate to statute and regulation

The Policy Manual is highly important for predicting USCIS adjudication, but INA § 101(a)(15)(L) and 8 C.F.R. § 214.2(l) remain the controlling higher-level authorities.
