What the governing framework requires

E-2, L-1, and EB-5 should not be compared using one processing-time number. E-2 may involve direct consular visa processing or USCIS status processing. L-1 generally uses an employer petition and may then require visa issuance. EB-5 involves an investor petition, visa availability, adjustment or consular processing, conditional residence, and Form I-829. Duration of status is also fundamentally different from processing time.

Procedure depends on consular or USCIS processing

Visa validity is separate from the period of admission or authorized stay.

E-2 procedure depends on where and how classification is requested. A person abroad commonly applies for an E-2 visa through a US consular post, while an eligible person in the United States may request a change or extension of status through USCIS. Visa validity, admission, and authorized stay are separate concepts. A visa can permit travel to seek admission during its validity period, while the period the person may remain in the United States is determined through the admission or status process.

E-2 does not use the same aggregate maximum as L-1

Qualifying E-2 status can potentially be extended or renewed repeatedly while eligibility continues.

E-2 does not use the same aggregate five or seven year maximum that applies to L-1. Qualifying E-2 status can potentially be extended, and an E-2 visa can potentially be renewed, while the investor and enterprise continue to satisfy the classification requirements. That does not mean status is permanent or automatic. Each extension, admission, or visa application remains subject to the applicable rules, and the investor must continue to maintain the treaty enterprise, qualifying role, ownership or control, and the required intent concerning departure when status ends.

L-1 contains classification-specific maximum periods

L-1A generally permits up to seven years and L-1B generally up to five years.

L-1 has classification specific maximum periods of stay. L-1A managers and executives generally may receive up to seven years in L status, while L-1B specialized knowledge workers generally may receive up to five years, subject to the regulatory rules for counting time and exceptions. Petition validity, visa validity, and authorized stay should still be distinguished from one another. Employers should track the beneficiary's L history and prior periods in the United States rather than assuming every new petition begins a fresh maximum period.

Initial new-office approval is limited

The initial new-office petition is generally limited to one year.

An L-1 new office petition receives a limited initial period because the US operation is still developing. The first approval is generally limited to one year. An extension requires evidence that the business has progressed beyond the startup stage and, for L-1A, can support the beneficiary in a primarily managerial or executive capacity. The first year should therefore be used to document actual business activity, staffing, payroll, premises, contracts, revenue, organizational development, duties, and continued qualifying foreign operations rather than relying only on projections from the original petition.

EB-5 is a multi-stage immigrant process

Petition adjudication, visa availability, Green Card processing, conditional residence, and I-829 are separate stages.

EB-5 is a multi stage immigrant process, so one processing time cannot describe the entire path. The investor petition is only one step. Visa availability, immigrant visa processing or adjustment of status, admission or approval as a conditional permanent resident, and later removal of conditions through Form I-829 are distinct stages with separate eligibility and procedural requirements. The time between stages can also depend on visa availability and individual case circumstances, so a comparison with E-2 or L-1 should distinguish processing time from the duration of immigration status.

Avoid hardcoding temporary agency processing estimates

Processing times and Visa Bulletin conditions change.

Agency processing estimates and Visa Bulletin conditions change, so a durable comparison should explain the process rather than hardcode a temporary prediction. Current USCIS processing information, Department of State visa availability, consular scheduling, premium processing availability where authorized, requests for evidence, and case specific facts can all affect timing. Before making a filing or travel decision, check the current sources for the relevant form, post, and preference category. The legal maximum duration of a status should not be confused with how long the government may take to adjudicate a particular filing.
