What the governing framework requires

The EB-5 process normally begins with Form I-526 for a standalone investor or Form I-526E for a regional center investor. When an immigrant visa is available, the investor proceeds through adjustment of status or consular processing. The investor, spouse, and qualifying children initially receive conditional permanent residence and later remove conditions through Form I-829.

Structure the investment before filing

The investor should confirm the required capital amount, lawful source, path of funds, new commercial enterprise, job creation model, management rights, and project classification.

The EB-5 process starts with structuring a qualifying investment rather than with filing a form. The investor should determine the required investment amount, whether a reduced amount applies, the lawful source and path of the capital, the new commercial enterprise, the job-creation framework, and the investor's management rights. In a regional center case, the associated project filing and reserved or unreserved classification also matter. The transaction documents and transfer records should be completed consistently with the immigration strategy so that the later petition can show what the investor actually invested rather than describe a different transaction on paper.

File the correct immigrant petition

Standalone investors use Form I-526.

Regional center investors use Form I-526E after the associated Form I-956F has been filed.

The investor petition depends on the investment structure. A standalone investor generally files Form I-526. A regional center investor files Form I-526E after the associated regional center has filed Form I-956F for the offering and capital investment project. The petition should establish investor-specific eligibility, including source and path of funds, while relying on the project record where the statute permits. Approval classifies the investor for EB-5 purposes but does not itself confer permanent residence. The priority date and visa category then determine when the investor can move to adjustment of status or immigrant visa processing.

EB-5 remains a numerically limited immigrant category

The investor's priority date and visa category determine whether adjustment or immigrant visa issuance can proceed.

Reserved and unreserved EB-5 categories can have different availability.

EB-5 is numerically limited, so visa availability can control the timing between the investor petition and permanent residence. The analysis should identify the priority date, country of chargeability, and whether the investor is in a rural, high-unemployment, infrastructure, or unreserved category. The Department of State Visa Bulletin can establish final action dates and filing dates, while USCIS announces which chart adjustment applicants may use. Reserved and unreserved categories can move differently as demand develops. Petition approval therefore should not be treated as a guarantee that Form I-485 can be approved or an immigrant visa immediately issued.

Choose adjustment of status or consular processing

An eligible investor in the United States may pursue Form I-485 when the statutory and visa-availability requirements are satisfied.

An investor processing abroad generally proceeds through the Department of State immigrant visa process.

When a visa number is available and the investor is otherwise eligible, permanent residence is completed through adjustment of status in the United States or immigrant visa processing abroad. An eligible applicant in the United States may file Form I-485 under the applicable adjustment rules, including concurrent filing when permitted by visa availability and the governing EB-5 provisions. An applicant abroad generally completes Department of State immigrant visa processing. Each route has separate procedural requirements, and derivative family members have their own applications or visa records. The result is conditional permanent residence under INA 216A rather than an unconditional Green Card at the outset.

The first EB-5 residence period is conditional

INA §216A places EB-5 investors and qualifying derivatives in conditional permanent resident status.

The conditional period ordinarily runs for two years.

The investor and qualifying derivatives generally receive conditional permanent residence for a two-year period under INA 216A. Conditional residents are lawful permanent residents, but the investment-based conditions must later be removed. The residence start date is important because it controls the Form I-829 filing window and may differ among family members who immigrate at different times. During this period, the project should preserve the evidence that will later be needed to document the qualifying investment, applicable sustainment requirement, job creation, and material project developments. The investor should also retain all residence and travel documentation.

Form I-829 completes the EB-5 immigration sequence

  • File during the statutory window
  • Document qualifying investment
  • Document applicable sustainment
  • Document job creation
  • Address project changes
  • Include qualifying derivatives

Form I-829 is the removal-of-conditions stage of the EB-5 process. Current USCIS instructions require filing during the 90-day period immediately preceding the second anniversary of obtaining conditional permanent resident status. The petition addresses the investment, applicable sustainment requirement, job creation, and other facts relevant to removal of conditions. A timely accepted filing extends conditional resident status for the period stated on the receipt notice while USCIS adjudicates the petition. Because the I-829 record depends heavily on what actually happened after the original investor petition, project records should be collected throughout the conditional period rather than reconstructed only when the filing window opens.
